JILL PRESCOTT AGREES TO PROVIDE THE SERVICES DESCRIBED ON OUR WEBSITE FOR WHICH YOU SIGN UP ONLY UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THIS AGREEMENT. PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT CAREFULLY. IF YOU AGREE TO THE TERMS OF THIS AGREEMENT, SELECT THE “ACCEPT” BUTTON AT THE BOTTOM OF THIS AGREEMENT. IF YOU ARE NOT WILLING TO BE BOUND BY ITS TERMS, SELECT THE “DECLINE” BUTTON UNDER THIS AGREEMENT AND YOUR ORDER WILL NOT BE PROCESSED.
ARBITRATION
Any dispute, whether in contract, tort or other theory, arising out of or
relating to this Agreement shall be finally settled by arbitration as set
out herein. Arbitration arising hereunder shallbe administered in accordance
with the rules of the American Arbitration Association ("Rules") in effect
at the time of arbitration as modified herein and judgment upon the award
rendered by the arbitrator may be entered in any court having jurisdiction
to enforce such awards. Each party will be responsible for its own fees and
costs of preparing its case. Both parties will share equally the fees of the
arbitrator. The arbitrator shall consider and apply the substantive and
procedural laws of the State of California in deciding any dispute and may
only provide such damages and provisional relief available under such
controlling law and this Agreement. All arbitration proceedings shall be
conducted in English in Napa County, California.
ENTIRE AGREEMENT
This Agreement is the parties' entire agreement relating to its subject
matter. It supersedes all prior and contemporaneous oral and written
communications, proposals, conditions, representations and warranties and
prevails over any conflicting or additional terms of any communication
between the parties relating to its subject matter during the term of this
Agreement. No modification to this Agreement will be binding unless in
writing and signed by an authorized representative of each party.
LIMITATION OF LIABILITY
To the extent not prohibited by law, in no event will Jill Prescott or its
vendor-partners be liable for any direct, indirect, punitive, special,
incidental or consequential damage in connection with or arising out of this
Agreement (including loss of business, revenue, profits, or other economic
advantage, however it arises, whether for breach or in tort, even if
Prescott and its vendor-partners have been previously advised of the
possibility of such damage.
DRESS CODE
Dress code for the cooking classes; Students are required to wear slacks or
jeans, long sleeved shirts or blouses and non-skid comfortable shoes with
socks. No sandals, open toe shoes, or shoes with elevated or high heels ,
short sleeve tops, or shorts are allowed in the classes. Tennis shoes with
socks are fine. If you are signing up for a friend, this information must be
passed on to them by you prior to the class, tour, or event as well. Long
hair needs to be secured back. The dress code is required for your safety
while in a busy kitchen.
CANCELLATION POLICY: Cooking Classes Cancellation Policy
The cancellation policy for cooking classes payment secures your
reservation. The fee for All Classes includes all the activities listed in
the description of the classes found on our website. Tours must be paid in
full at the time of registration. This fee does not include airfare, hotel,
car rentals, or any other expense you may incur.All Classes are
non-refundable but are transferable by you to another individual of majority
age for only the same class on the same day for which you registered,
provided you inform Jill Prescott in writing in advance. You (or your
replacement individual) may not transfer from one class to another. If the
class is canceled by Jill Prescott a full refund will be given. We strongly
suggest participants buy a travel cancellation policy separately which must
be purchased within 10 days after paying for the tour. Insurance can be
purchased through Travelex 800.228.9792 or www.travelexinsurance.com or a
company of your choice We have no affiliation with Travelex and provide
their name for your convenience only. Jill Prescott is not responsible for
any arrangement you make with Travelex or any other independent vendor or
service provider. If a tour is cancelled by Jill Prescott a full refund
will be issued.
CANCELLATION POLICY: Food and Wine Tours Cancellation Policy
Food and Wine Tours Cancellation Policy: The cancellation policy for All Tours secures your reservation.The fee for
the food and wine tours includes all the activities listed in the
description of the tour found on our website. Tours must be paid in full at
the time of registration. This fee does not include airfare, hotel, car
rentals, or any other expense you may incur. All Tours are non-refundable
but are transferable by you to another individual of majority age for only
the same tour on the same day for which you registered, provided you inform
Jill Prescott in writing in advance. You (or your replacement individual)
may not transfer from one scheduled tour or tour day to another. If the
class is canceled by Jill Prescott a full refund will be given.We strongly

CANCELLATION POLICY: Corporate or Private Events
A non-refundable deposit of the greater of $1,000 or half of Prescott’s
estimated amount of the event is required upon reserving the date. The
balance is due no less than 60 days prior to the event date. Additional
charges must be paid to Prescott immediately following the event “Any
additional charges for services of Prescott which you order in advance or
during an event and which are outside of the original agreed-to fee must be
paid at the conclusion of the event on that day. This fee does not include
airfare, hotel, car rentals, or any other expense you may incur. All Events
are non-refundable but are transferable individual to individual of majority
age for only the same event on the same day for which the event was
registered, provided you inform Jill Prescott in writing in advance. You (or
the replacement individual) may not transfer from one scheduled event. If
the event is canceled by Jill Prescott a full refund will be given.We
strongly suggest event participants buy a travel cancellation policy
separately which must be purchased within 10 days after paying for the tour.
GIFT CERTIFICATES
Gift certificates are non-refundable. If a gift certificate displays a specific event, the gift certificate is valid for that event on that day only. If the gift certificate displays a dollar amount in can be applied to any public event. To redeem your gift certificate you must mail your gift certifcate, registration sheet, and a signed terms and conditions page to JillPrescott Creating Culinary Experiences, PO Box 3404, Napa California 94558. We are not responsible for any lost or misdirected mail.
INSURANCE OPTIONS
Insurance can be purchased through Travelex 800.228.9792 or
www.travelexinsurance.com or a company of your choice We have no affiliation
with Travelex and provide their name for your convenience only. Jill
Prescott is not responsible for any arrangement you make with Travelex or
any other independent vendor or service provider. If a tour is cancelled by
Jill Prescott a full refund will be issued.
